Apostille, pronounced as ‘Ah-pos-tile’, is a French word which means re-attestation or authentication.
Apostille authenticates that the Seal and Signature on the public Documents, issued by the authority, as such the
Document or Certificate could be identified by the foreign Countries who are the members of the Hague Convention
(HCC) 1961.
If anyone from India is planning to go abroad for higher Study or better Job purpose, then the candidate must have
to attest or Apostille their some essential personal Documents from Government of India as well as from the Embassy
or Consulate of the destination Country present in India. The personal Documents or Certificates are may be Educational
like Degree Certificate, Diploma Certificate, Mark Sheets or Transcripts etc and the non-Educational Documents like
Birth Certificate, Marriage Certificate, Police Clearance Certificate (PCC), Experience Certificate etc.
In India, the authority of Apostille on the Documents or Certificates (in both the purposes, Personal or Commercial)
is Ministry of External Affairs (MEA) or Ministry of Foreign Affairs (MoFA). Before Mea Apostille of Certificate,
it must be attested from the State Level Attestation Department. The State Level Departments are different from
different States in India.
If the Document is an Educational Degree Certificate then it will be attested from Higher Education Department
HED), Human Resource Department (HRD), NRI and Foreigners’ Department etc. and if the Document is non Educational
then it will be attested from Home Department of the State, General Attestation Department (GAD), Regional Attestation
Center (RAC), Sub Divisional Magistrate (SDM) etc.
In some cases if there is less possibility to complete the State Level Attestation prior Mea Apostille of the
Certificate due to some issues regarding time, availability of the candidate etc. in that case the Mea Apostille
of the Certificate will be done after the Attestation of Sub Divisional Magistrate (SDM), Delhi. Irrespective of
the state of issuance of the Certificate or Document but it must be personal.
Mea Apostille can directly be completed on the photocopy of Passport, Driving License (DL) etc. The Police
Clearance Certificate (PCC) which is issued from Regional Passport Office (RPO) also could be Apostilled by
Ministry of External Affairs (MEA) straightly.
Secondly, if some Indian Company wishes to Export their Products or wish to establish their business or even
wishes to appoint their Dealer or Agent in abroad, then the concern Company must have to Apostille, Attest or
Legalize some Commercial Documents like Power of Attorney, Certificate of Origin, Commercial Invoice, Packing
List, Free Sale Certificate, Phytosanitary Certificate, Good Manufacturing Practices (GMP) Certificate, Certificate
of Incorporation, Board Resolution, Memorandum and Articles, Power of Attorney (PoA) etc.
The MEA Apostille on Commercial Certificate will be done after the Attestation of Chambers of Commerce (CoC)
from anywhere in India. The Chambers of Commerce must be Govt. of India recognized like PHD Chambers of Commerce,
FICCI, ASSOCHAM etc.
